Terms of Use, Acknowledgement & Disclaimer Concerning KICA’s Online Service Provider Directory

The Kiawah Island Community Association, Inc. (“KICA”) means the corporation, its directors, officers, employees, agents and those acting under its direction or control.

The providers of goods and services listed herein (“subscribers” or “providers”) are not the agents of the Kiawah Island Community Association, Inc. (“KICA”). KICA does not endorse or recommend any particular provider to its members. Moreover, KICA has not reviewed the providers' skills or qualifications, nor determined that the providers are duly authorized and licensed. The providers have each paid a fee to be listed in the directory and have supplied their own data. The directory and its listings are for the convenience of KICA's members. Any member's decision to contact or hire a provider is made entirely at the member's discretion. KICA assumes no responsibility for the inclusion of any provider herein or for the member's selection of, hiring of, or satisfaction with any provider. KICA assumes no responsibility for errors, exclusions or omissions in the directory. KICA’s Online Service Provider Directory & Interactive Member Feedback Service

This directory is an interactive computer service that gives association members the ability to post feedback or reviews concerning listed service providers they have used. Members are under no obligation to post feedback and the decision to do so is solely at the member’s discretion. KICA does not censor member’s feedback or otherwise exercise editorial control. However, KICA has implemented the policies and guidelines outlined below to help prevent abuse of the feedback system.

The following conduct is prohibited in the service directory’s feedback forum:

Violations of this policy may result in a range of actions in KICA’s sole discretion, including but not limited to suspension of the your or the subscriber’s right to post feedback, as well as removal of the feedback.

Subscribers:

Subscriber acknowledges that KICA’s members and users of this service directory may publish feedback and comments concerning subscriber and subscriber’s provision of services/goods that will be available for viewing by members of the general public via the Internet.

Subscriber acknowledges and agrees that KICA is not responsible for feedback and comments published on the online service directory and has no duty to monitor, review, control, edit, or remove feedback and comments before or after publication.

Subscriber may, at his/her discretion, use the feedback system to respond to any feedback left by a member. The subscriber is subject to the same feedback guidelines as any other member.

Subscriber acknowledges and agrees that KICA is not responsible or liable for any defamatory, disparaging, or offensive feedback or comments published on KICA’s online service directory. Subscriber acknowledges and agrees that KICA is an interactive service provider as defined in the Federal Communications Decency Act.

Subscriber acknowledges and agrees that by entering into this agreement with KICA, it is forever waiving any and all rights to bring a claim, lawsuit, or cause of action against KICA in any forum arising out of or related to the publication of feedback or comments on KICA’s online interactive service directory.

In the event subscriber brings a claim, lawsuit, or cause of action against KICA, subscriber acknowledges and agrees that it shall be liable to KICA for all attorneys’ fees and costs incurred by KICA in defending against the claim, lawsuit, or cause of action.

Feedback Abuse, Withdrawal and Removal

KICA reserves the right but is not obligated to remove feedback, ratings, and comments if they meet the standard for feedback abuse outlined herein. Once feedback has been approved by KICA, you cannot alter it or post additional feedback.

You could be held legally responsible for damages to a service provider’s reputation or for disparagement of its products, if a court were to find that the remarks constituted libel, defamation, or product disparagement. Under federal law (the Communications Decency Act), because KICA does not censor feedback or investigate it for accuracy, KICA is not legally responsible for the remarks that members post, even if those remarks are defamatory. However, this law does not necessarily protect the person who posts the feedback from responsibility or liability for it. If you have questions concerning personal liability for feedback, you should consult your legal counsel.

Though feedback is a system generated by its members/subscribers and not censored by KICA, there are specific, limited occasions when KICA will remove feedback comments. Feedback that meets any of the circumstances below is feedback abuse and may be subject to removal. Feedback will be removed for the following reasons:

To the extent any member is concerned about their children viewing the content of any feedback or other messages or materials posted on this interactive computer service, please be advised that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist the customer in limiting access to material that is harmful to minors.
